Terms of Service

Last updated:

These terms are the agreement between you and BenchPulse (“BenchPulse,” “we,” “us”) for using the BenchPulse app and website. By creating an account or using BenchPulse, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use BenchPulse.

Who can use BenchPulse

You must be at least 18 years old and able to enter into a binding agreement to create an account. BenchPulse is built for the coaches, managers and volunteers who run hockey teams. Players don't need accounts.

Your account

Give us accurate information when you sign up, and keep your password private. You're responsible for what happens under your account. If you think someone else has access to it, change your password and tell us at support@benchpulse.app.

Running a team

When you create a team, you become its admin. Team admins decide who can see the team's information and are responsible for:

  • Only inviting people who should have access, and removing people who no longer should
  • Having permission to add players' names and stats to BenchPulse, including from parents or guardians where required
  • Making sure the information entered about players is accurate and appropriate

Your team's information

Your team's information belongs to your team. By using BenchPulse, you give us permission to store, process and display it only as needed to run BenchPulse for you and the people you invite. We don't claim ownership of it, and we don't sell it.

If you send us ideas or feedback, we may use them to improve BenchPulse without owing you anything.

Using BenchPulse responsibly

When using BenchPulse, you agree not to:

  • Try to access another team's information, or anyone else's account
  • Test, probe or attack BenchPulse's security without our written permission
  • Copy, scrape or resell BenchPulse or its data, or build a competing product from it
  • Interfere with how BenchPulse runs, or overload it on purpose
  • Enter information you don't have the right to share, or use BenchPulse to harass or embarrass anyone, including players
  • Use BenchPulse for anything illegal

If you find a security issue, please report it to support@benchpulse.app.

Free service and changes

BenchPulse is currently free, and we intend to always offer a free version. We're improving BenchPulse all the time, which means features may be added, changed or removed. We may also introduce paid features or advertising in the future. If we plan a change that reduces what the free version includes, we'll give you at least 30 days' notice.

Availability

We work hard to keep BenchPulse running smoothly, but we can't promise it will always be available or error-free. BenchPulse saves stats on your device when the rink wifi drops and syncs them later, but we can't guarantee that information will never be lost.

Ending your use of BenchPulse

You can stop using BenchPulse at any time, and you can ask us to delete your account or team as described in our Privacy Policy.

We may suspend or close an account or team that breaks these terms, or that puts BenchPulse or its users at risk. Where it's reasonable, we'll tell you first and give you a chance to fix the problem.

If we ever decide to shut BenchPulse down, we'll give you at least 30 days' notice.

Disclaimers

BenchPulse is provided “as is” and “as available.” To the extent the law allows, we don't make any promises about BenchPulse beyond those in these terms, including that it will meet your needs or that stats will be free of errors. Stats are only as accurate as the information entered.

Limitation of liability

To the extent the law allows, BenchPulse won't be liable for any indirect or consequential losses, or for lost data, arising from your use of BenchPulse. Our total liability for any claim related to BenchPulse is limited to CAD $100. Some places don't allow these limits, so they may not apply to you.

Responsibility for your content

If a claim is made against BenchPulse because of information you entered without the right to share it, or because you broke these terms, you agree to cover the resulting costs, to the extent the law allows.

Changes to these terms

If we make important changes to these terms, we'll let you know by email or in the app before they take effect. If you keep using BenchPulse after changes take effect, you're agreeing to the updated terms.

Governing law

These terms are governed by the laws of Ontario and the federal laws of Canada that apply there. Any dispute will be handled by the courts of Ontario.
